Shipping and Returns

INTERPRETATION

In these Conditions the following words shall have the following meanings

The Buyer/You:
The person(s), firm or Company who purchases the Goods from the Company

The Company/We:
Margin Services Ltd. (trading as Spares2you)

Contract:
Any Contract between the Company and the Buyer for the sale of the Goods, incorporating these Conditions

Goods:
Any goods agreed in the Contract to be supplied to the Buyer by the Company (including any part or parts of them)

SHIPPING, HANDLING AND DELIVERY:

Although every effort is made to keep our stock as up to date as possible, we will occasionally run out of stock. This is beyond our control. We will however inform you of this shortage by e-mail or by telephone call and will advise you on the status of the order after 5 working days of the Buyer requesting an order and we will wait till the full order can be shipped unless advised otherwise by the Customer. Whilst we monitor stock constantly it is updated by us as stock is sold, this however may mean that products showing ‘in stock’ have been allocated on a first come, first served basis. If this is the case we will notify you as soon as possible of the position if there is going to be a delay.

All orders must be delivered to the cardholders address, address checks can and will take place, so to avoid unnecessary delay please ensure the correct address is given. Delivery to PO boxes is not possible.

DELIVERY INFORMATION

You should receive your order within 7 working days from dispatch (Royal Mail dependant) but normally within 2-3. If for any reason there is a delay we will notify you, normally by email.

Delivery charges

  • Royal Mail Tracked 48: £3.49
  • Royal Mail Tracked 24: £5.99

Royal Mail Tracked 24 is not a guaranteed next day service it is a 1-2 working days in most cases your item will be delivered in 1 working day from dispatch.

We do not prioritize Royal Mail 24 Services any quicker than Royal Mail 48 Service, it just means from point of dispatch your item will be handled quicker by Royal Mail using the 24 hour service. 

We use Royal Mail Tracked for most orders but may use a courier at our discretion.
Couriers are only available for UK Mainland and not available for the Channel Islands, Northern Ireland and Isle of Wight etc. You can check the cost of the postage at any time, by logging into your account and following the checkout procedure. You do not have to make a payment before the postage cost is calculated.


RISK
The Goods are at the risk of the Buyer from the time of delivery.

Ownership of the Goods shall not pass to the Buyer until the Company has received in full (in cash or cleared funds) all sums due to it in respect of:
(a) The Goods and
(b) all other sums which are or which become due to the Company from the Buyer on any account.

PRICE
Unless otherwise agreed by the Company in writing the price of the Goods shall be the price set out in the Company's price list published on the date of delivery or deemed delivery

The price of the Goods shall be inclusive of any value added tax and all costs or charges in relation to reloading, unloading, carriage and insurance all of which amounts the Buyer will pay in addition when it is due to pay for the Goods.

PAYMENT
Payment for the price of the Goods is due when the Goods are ordered. Payment can be made by Visa, MasterCard and Switch

Time for payment shall be of the essence.

No payment shall be deemed to have been received until the Company has received cleared funds and the price quoted will be inclusive of VAT and prices will always be quoted in pounds sterling

The Buyer shall make all payments due under the Contract without any deduction whether by way of set off, counterclaim, discount; abatement or otherwise unless the Buyer has a valid court order requiring an amount equal to such deduction to be paid by the Company to the Buyer.

LIMITATION OF LIABILITY
The following provisions set out the entire financial liability of the Company (including any liability for any acts or omissions of its employees, agents and sub-contractors) to the Buyer in respect of:
(a) Any breach of these conditions; and
(b) any representation, statement or tortuous act or omission including negligence arising under or in connection with the Contract.

We shall not be liable for incidental or consequential damages or expenses. This includes, but not limited to, damage to property, lost income, profits, economic or commercial losses and third parties claims.

Nothing in these conditions excludes or limits the liability of the Company for the death or personal injury caused by the Company's negligence or Fraudulent misrepresentation.

CIRCUMSTANCES BEYOND OUR CONTROL

The Company reserves the right to defer the date of delivery or to cancel the Contract or reduce the volume of the Goods ordered by the Buyer (without liability to the Buyer) if it is prevented from or delayed in the carrying on of its business due to circumstances beyond its reasonable control of the Company including, without limitation, acts of God, governmental actions, war or national emergency, acts of terrorism, protests, riots, civil commotion, fire, explosion, epidemic, lock -outs, labour disputes (whether or not relating to either party's workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable supplies.

GUARANTEE'S AND WARRANTIES:
All of our products are covered under the manufacturer warranty and the Company will endeavour to transfer to the Buyer the benefit of any Warranty or Guarantee given to the Company. Please note that due to the nature of some of the products they are classed as consumables and are affected by use, care and fitting. Items that fall into this category are belts, filters, bags, tools and brush rollers etc. These items may not be covered by any warranty period.

 

FAULTY GOODS:
Faulty goods within 28 days- will be replaced by spares2you.
Faulty goods over 28 days-spares2you will contact the manufacture as each have their own policy’s on how to proceed.

 


RETURNS POLICY
Under the European Distance Selling Regulations the Buyer has the right to cancel the order for any item purchased on this web site for a full refund up to 14 working days starting the day after delivery. If you cancel your order under the Distance Selling Regulations and have chosen courier delivery we will only refund the standard rate of postage unless the goods are faulty or misdescribed, in which case please contact us.

To cancel the Buyer must e-mail or write to the Company within seven working days starting the day after delivery of the item(s) quoting your order number. The Buyer is obliged to take reasonable care of the items and return it in an unused condition with the original packaging and accompanied by the original receipt. The Buyer is obliged to return the goods at their own cost within 30 days; the Company will not refund this cost. The Buyer is responsible for the goods until they are back in the possession of the Company, the Buyer must claim for any damages caused on the return, from the courier used. If the goods are not returned in an unused condition then the right to a full refund is forfeited. The product packaging must also be returned reasonably intact condition.

When returning items that are deemed to be faulty, the Buyer must contact the Company by telephone, prior to sending the articles back and obtain instructions and an authorised return reference from the sales staff.

The Company shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow manufacturers instructions, misuse, alteration or repair of the goods (other than that done by our staff).

In other instances we will consider an exchange or credit note provided that the goods are returned promptly; in their original condition and with the original receipt.

We will issue a refund within 21 days of receiving the item(s) back after an inspection of good received.

DATA PROTECTION
The purpose of this statement is to set out how we use any personal information that we obtain about you. By registering as a user and by using spares2you generally you agree to this use.

Margin Services Limited does not disclose Buyer's information to third parties. Cookies will be used to keep track of the contents of your shopping basket once you have selected an item. Cookies will also be used to store delivery addresses and any required information if you select the 'Remember Me' option.
When you submit an order to our online shop you will be asked to provide certain information such as your contact details. We will store this data and hold it on computers or otherwise. We will use this information to fulfil our agreement with you.
We may use information that you provide or that is obtained by us:
